BOZEMAN, Mont. (AP) — The Montana Department of Revenue says same-sex married couples in the state are also considered married for income tax filing purposes.
Guidance from the Internal Revenue Service last summer said same-sex couples who were legally married in a state that recognizes same-sex marriage are considered married for federal income tax purposes, regardless of their state of residency.
A federal judge overturned Montana's ban on same-sex marriage on Nov. 19.
